seeking surrogate mother

My wife and I are seeking a gestational surrogate mother to implant our own embryos. We have tried everything possible ourselves but failed. If anybody has any lead on how to search for one or know of anyone that may be willing to do so in China or HK, we would really appreciate your help. We are prepared to do whatever it takes to structure a legally aceptable framework. Thanks.

has your re suggested that this is the best alternative for you given your diagnosis?
first step - find out if it illegal. call a clinic or ask your re.
next step - if you have the funds, see if you have the means to be creative about surrogacy.
one website (and am not sure if this is the best way to find a surrogate, probably the best way is to find a clinic that does surrogacy), but here it is, this will at least give you some idea of prices:

I did a bit of research on this matter about a year ago and was told:
1. You need a doctor recommendation to opt for surrogacy (basically to show that there is no other option)and use it to get the government approval.
2. Even with the doc's recommendation and the government approval, there cannot be any financial transaction (the surrogate cannot be paid - meaning that it's better to have a family/close friend to help you out).

To all, thank you very much for your responses. Our doctor has indicated that he may support surrogacy given my wife's medical situation. But it still looks like we may have to consider other options,eg outside Hong Kong.

I have done a lot of research as I am going to do it as well.
I think you better go to Thailand, or India for surrogacy program. The law are very flexible there and most of the hospital provide IVF+surrogacy package, you better find one hospital that provide surrogate mother as well, it is easier for you.
Once the baby are born, you have to find a lawyer to do the adoption documents.
You can do it in US but prices will be much higher

Hi Melissa Y, the problem that we have right now is that we still have 3 frozen embryos here in HK. So we either have to get a surrogate mother here in HK(where the law is difficult like you mentioned but the transfer will be easy), or shipped our embryos to another country(in which case the law will be more flexible but the journey might traumatised the poor fragile embryos). And if that fails, then we will consider both donor eggs+surrogacy in another country. You have done alot of research on this, what do you think about doing it in thailand? We may plan a trip there next week to check it out ourselves.

That is also actually what I am going to do as well, bring frozen embryos to India for surrogate mother. I have done my IVF in Belgium.
I have some good grade embies and I want to transfer to surrogate mother instead to me
The doctor in India refused us to send them by courier and only accept us if we handcarry the dry shipper or check in, this way is sure will not lose and avoid the screening. The whole procedure is quite simple as you are not doing fresh cycle. The problem is only airline, I asked travel agency to help me to declare the check in embryos to airline, it takes quite some time for the airline to approve as they are too shock to hear that, u know what I mean.
But this way they will handle the dry shipper carefully and not do the screening.
I have contacted Ram hospital in Thailand and it seems about it and it seems they are not really interested to do this way.
You better ask a hospital to handle the whole case for you, it is easier with the law and emotion of the surrogate mother.
India govt is making the law of surrogacy program very easy for foreigner, the hospitals can also find surrogate mother without problem.
For you case I will do in India, fresh cycle better in Thailand as the surrounding is nicer and more comfortable.

Hi Melissa, thanks for your advise. I think we are going on the same path as you. In terms of finding a surrogacy, thailand is out unless we do fresh ivf cycle with them. Malaysia seems willing to do it for us. I have not contacted India. We are now in the process of finding a surrogate mother 1st, then figure out how to hand carry the embryos by plane. Please let me know your progress on the airlines. thanks again & good luck.

At which point in time did you decide to use a surrogate mother? I have had one IVF; one IUI (with meds) and one IUI (without meds). I was just wondering how many times did you try before deciding to go with this route.

To bring frozen embryos to other country with flight is much more complicated than I expect. After 911, this kind of dry shipper become very sensitive for the airline. I have contacted with some airlines, the easiest are KLM, Austrian airline and Lufthansa. I have a lot of trouble to find a dry shipper myself as our hospital could not offer us one. Will your hospital provide you a hand carry dry shipper?
Try to ask the hospital to find a surrogate mother for you, to find a surrogate mother abroad or through internet can be very risky especially if you are not local.

Havefaith, don't worry, you are far from that route. Many people I know did a couple of IVFs before they succeed. My wife had an ectopic pregnancy from an IVF which scarred her reproductive system, that's why we have to find a surrogate. She has been through alot for us trying to have a baby, numerous ivfs, miscarriage & now ectopic. So I'm going to take charge now & give her a break from all these.
Melissa, our hospital/doctor in HK will not find a surrogate for us. We have to find one ourselves. I haven't called & ask if the hospital provide a hand carry dry shipper. I assumed they do but after talking to you, I will definitely call & find out. I am on my way to Thailand & Malaysia now to look at possible surrogate/egg donor candidates. Will update you on the route that we are taking. eg ship embryo to surrogate or bring surrogate to HK.

I have tried 9 x IVF with one of the best hospitals in Europe, all failed. They did all tests for me, everything came back normal, sperm from hubby is good. I think it is called unexplained. I did my embryos always with PGD, one time even put back 4 perfect embies after PGD. The problem is either me or embies, if I have implantation problem, not sure donor egg will work for me. That s why I want to find out by putting these embies to a surrogate mother who delivered healthy baby before. In yr case you should try more yourself first, surrogacy route is quite complicated.

We did a lot of looking into surrogacy as well. India is the place. We first read about it in the newspaper in Canada late last year. We communicated alot with them and if you do require eggs, they have pics and stats on all the surrogae mothers. It is a great idea. In the end, we adopted a beautiful little girl here in HK

Melissa, I am having problems getting in touch with the coordinator in Thailand(have not been returning my calls for 2 days & we are supposed to meet tomorrow morning) In fact, this is not the first time they have been unresponsive. Can you please advise which hospital did you liase with in India? Thanks.
Jassy, I am happy for you & your baby girl. We also thought about adopting in HK, attended the workshops & filled up the forms but I am leaving HK soon for another job, so have to give up on this path. BTW, how long does it take you for the whole adoption process to be completed? from starting the paperwork to having the baby at your home?

Have faith, quality of eggs of the women will decline slowly, or you can use donor egg later.

Most of the donor in india are indian origin. I think most chinese prefer chinese origin. I find the trip to india is much more stressful than thailand, applying visa, many vaccinations, communication is not easy..., hotel in mumbai is very expensive and basic, 100 euro you will get a basic room only, woman is also not so easy to stay alone in india to do IVF..BUT the law there is very flexible, i have heard that a single man can just go there alone , choose a egg donor and surrogate mother and make a baby for himself only (legally).

I have feeling that Ram only like to do the whole IVF + surrogacy + donor..., outside this whole process they are not interested.
But if u already made app with Dennis house, then u can just go to Ram tomorrow if u make sure he is there. so far I only know India is best place can bring the frozen embies in, I have heard that many people are already doing it, less stress than doing fresh cycle there. Price is only 2000 US or so cheaper than fresh cycle.
You better do it in Mumbai, the international airport is there and best hospitals are also there.

Dr Gautam Allahbadia (rotunda) is doing the IVF inside hiranandani hospital. Check the hygiene of the IVF clinics before you start it, don.t try countryside, use the reputable one in the big city if possible.
There are two other ways of surrogacy u can consider:
use good donor egg (find one look like u, e.g. blood, height, origin..), find another surrogate mother(already mother) to a carry the child, this way is more promising but costly. Or use the egg of the surrogate mother self, procedure is easy but emotionally is bit hard for the surrogate mother. I am considering the first one if using my own eggs fail.

From th first workshop to the approval date, took us approx. 11 months. Normally would have been 9 months, but we were out of HK for almost 2 months during that time frame. Then it took us 4 months to the call that a child has been matched. You visit the baby/child for a couple weeks to b sure he/she is what you want and then take them home. Once they are in your home, after 6 months you go to Court to finalize everything.

i've met with the ram hospital (thai team). they seem reasonably competent and has assured us that they have done this many times. the surrogate profiles also look reasonable. the only problem need exploring is the fact that the thai government apparently might be passing a new legislation to make surrogacy legal (provided no money change hands except for expenses) and how this impact the birth certificate.
some of you are travelling to see thailand, malaysia and india also. just wanted to hear your feedback.

I am new in this forum. We went thro' the same process of most of you. We failed 8 IVF cycle. I had a question to bsm about her trip to ram hospital. I was originally arraged to do the surrogacy program with them. Did you meet Denise House. Did they ask you to pay fees upfront before their program. Did they explain to you the legal issue. Will you be named as the mother in the birth certificate or you have to do an adoption/motherhood surrender order in a Thai court. I had asked them these question before but they simply ignored us.

hello my888 - sorry to hear what happened to you. I hope what I tell you will help.
I have met with the Ram team. Regarding your questions:
1. Yes met with the key people (including dr)
2. At this moment, there is no requirement to pay all upfront (monthly for surrogate fee and any medical expenses pay as you go). BUT - the laws could change in Thailand regarding surrogacy (it will be legal as long as you pay ONLY the surrogate general expenses), which I believe is the reason why Dennis asked for payment upfront for protection in case the law changes while the surrogate is 4 months pregnant. There is talk that the deadline is around September. Also remember the government might be changing.
3. Yes, if you are referring to the pending legislation and how it impacts the various facets of the program.
4. The "who is the mother" issue is also complicated by the pending change in law. Any baby born now, yes the woman shares the DNA material of the baby is the birth certificate mother. If the law indeed changes, it might complicate the issue. Partly because RAM is a listed company in Thailand and there are certain guidelines they need to adhere to but, at the end of the day, this is Thailand (there is no law on surrogacy right now in Thailand). My view is that it should not pose a huge problem and I will explain why later.
As I am not certain of your circumstances or the nature of the surrogacy, it's difficult for me to put things into perspective. However, I have read your message in the other post and I regret that you did not meet with the Dr in charge at Ram. I have and he is good (in fact better than the other doctors I have in 2 other very "reputable" Bangkok hospitals) and he can answer your questions. He makes it clear what he can do and cannot do. He also has detailed ultrasound/pictorial documentation of cases he worked with (anonymous). In my case, I was never given a clear answer regarding which name goes onto the birth certificate (I was explained what the hospital's policy is currently and what it will be if the proposed legislation becomes effective) but I was only given a definitive answer by the doctor (because he is the one who has control over this issue).
Back to the issue of birth certificate, in my case, I will be the mother. I can only tell you that the whilst the birth certificate was something we needed to consider, it was not a deal breaker because as long as the baby's father's name is on the birth certificate, the baby can get a passport of his/her dad's nationality and can leave the country safely. This implies that whether my name is on the birth certificate at the point of taking the baby out of Thailand is not that important because it an admin matter that I can deal with later and a risk I am willing to take (as long as you are with a country where if you can prove you share the same DNA material with the baby, then you are naturally the baby's mother). You need to check with the embassy (my experience is to not explain to them about surrogacy and Thailand, etc. Just ask them straight if you did a DNA test and the baby is yours then what can they do regarding passport. Otherwise they will be very reluctant to answer your questions and ask you to retain legal counsel instead).
I understand that RAM have worked with various nationalities without problems.

Can you tell mewhich hospitals in Bangkok you met with and what did they tell you about surrogacy? My experience is that they don't want to get involved.

Hi, I am still in india. To bring the frozen embies with flight(KLM) was like nightmare for us. Both hospitals are easy going, but the airline was terrible. The travel agent has helped us to declare four times to the airline, we did it becasue we hope the airline will be careful and not screening the dry shipper. However, once we arrive the airport, the check in desk could not find the information of the dry shipper in their system, he put some lables 'fragil' all around the cover box of the dry shipper, once we arrived to india aiport, the dryshipper was thrown to the luggage band and the part of the cover box of the dry shipper was broken. Owing to technical problem, my baggage was arrived 2 days later from amsterdam. Luckily the dry shipper could arrive same days as us. We went to the hospital immediately and gave them to the lab.
According to the doctors, the way they defroze the embies is different than the hospital that I have used in Europe, they need to contact my hopsital in europe to get more information or even ask for the same liquid they use to defroze embies, this way he hopes it will not damage the quality of the embies.
My advice is that if you cannot bring embies with handcarry, u better just do the fresh cycle, price will not be much higher and you can forget all this adminstrations from airline, renting dryshipper...

I have met the doctors team in india and i found they are not very organise. They already found a surrogate mother for me and i have paid part the ivf costs to the hopsital. It is also not very easy for women to walk on the street alone, hotem room is very expensive.If i have to do fresh cycle, i wish i could do it in thailand if at that time is still possible with the law

Surrogacy Bill earns approval
Wijarn Jiansane, a father of triplets, was crossing his fingers while listening to a discussion of experts on the second draft of the Surrogacy Bill yesterday.
"I hope the country adopts this kind of law as I would then have legal rights as the biological father of my children," said Wijarn, whose biological triples were delivered from another woman, not his wife.
Due to his wife's health problems, the couple had asked a woman to be the surrogate mother of their babies.
The children were then recognised by law as children of the surrogate family.
Wijarn attended the public debate on the Surrogate Bill, an attempt by the Council of State to regulate surrogate motherhood.
This was the second time the bill had been brought up for public comment by the committee drawing the bill. The first time was earlier this year when the bill was strongly criticised by experts.
Nandana Indanond, a judge who was funded by the Council of State to conduct a research of similar law in other countries and draw up the draft, said the draft put up for comment yesterday was a revised version from comments collected from the previous debate.
Under the new version of the bill, a woman can legally carry a baby for another couple, but the surrogacy agreement must be approved by the court.
The draft allows surrogate mothers to receive money, but only for medical expenses and other expenses related to medical treatment, such as transportation.
The surrogacy agreement would not have legal standing in court. A couple who asked another woman to carry a baby must be the owners of the egg and sperm and would be legal parents of the child, while the woman who carried the baby has an obligation to relinquish the baby to the couple.
The best interests of the child would be the foundation of the court to consider any cases of conflict between the surrogate mother and the owners of the egg and sperm.
Experts on reproductive technology and the law discussed the small points such as the minimum age of surrogate mother - to be 20, not 18 - and that legal surrogacy should be provided for all.
Meanwhile, homosexual advocates strongly criticised the bill as it deprived them of their rights to have their "own" baby.
Nandana said he would not revise the draft as demanded by homosexual advocates.
"We have to stick to the reason why we drafted the bill - to prevent commercial surrogacy and to protect the rights of the child born from surrogacy. I respect their [homosexuals] rights, but it is better to be stated in other laws, not this one," he said.

Here is what I learned:
- the legislation has been drafted and will attempt to pass through in September 2007
- once it is passed, it requires a formality by the king to sign off. there is an "incubation" period of at least 1 year - during this period, everything remains as before
- remember: the proposed legislation allows for surrogacy, as long as no money change hands (except for general expenses)
- I think what will complicate the RAM surrogacy program moving forward is the money changing hands. If you are keen to continue your dialogue, I suggest you work out an "all cash" payment schedule (which is what we plan to do) for the surrogate and agency fee.
- it's not that RAM will stop providing but I understand that when things become blurry (like now) and they are asked a lot of black and white questions, they simply cannot answer. Dennis told me that he starts to doubt whether he wants to continue the surrogacy program because it has become too time consuming and there are questions he simply cannot answer. It sounded to me that RAM will probably be more selective about clients.
Re your question whether it is too late to do a fresh cycle in Thai, I cannot answer but I urge you to speak to the Dr direct because he is in control of the entire process. When my husband and I met him, we genuinely liked him and felt that he is compassionate about helping.
He speaks good english, confident and has worked with many nationalities (Australians, Singaporeans, Americans, etc).

hi all, we just got back from thailand. We decided not to ship the embryos to thailand after talking to the doctor. He advised that the journey is too risky for the embryos. After talking to doctor, counsellor & lawyer in Hong Kong, it was proven that surrogacy in Hong Kong is just impossible to do. So now we are considering fresh ivf cycle with donor egg & surrogacy, will let you the outcome. BSM, I sent you a PM on another question. Thanks for your lawyer list.

I have also contacted with Dennis recently. He did ask me to pay upon the IVF cycle starts and ask me to bring cash to pay for an egg donor. He seems reluctant to answer any legal questions. I did book ticket to Thailand and give all my trust to Dennis.
I am desperate for a baby but also so nervous to risk my small pocket.

No, I've not met Dr Wiwat. All I have is contacting with Dennis through email. I am simply trust everything they present in their website. Do you mean that Dennis may not represent for Dr Wiwat? I also ask him let me talk with Dr Wiwat today but have not received any respond.
2. I dont know about Jetanin Institute. I did sent an email to them today. It seems to me that their service is quite expensive ($9000)

It's not clear in your post whether you have been in Bangkok. I think you should go:
1. It will give you comfort to know what you are really dealing with and save you from grief that you might not need later.
2. You need an egg donor so meeting as many people as possible is important. I suggest meet Jetanin and see their donor profiles and benchmark them against Ram.
3. Definately see Dr. Wiwat - you don't need Dennis for that. He is open to everyone: daily 830 am - 3 pm at Ram (Synphaet Hospital) then 430 pm - 730 pm (at another hospital). just show up and bring your passport. He is knowledgeable and speaks good English. I think a consultation is B1000 (if you use ivf or surrogacy program, then it's included in the "package"). Dr. has answered every question we had about his experience in surrogacy, including legal issues. He never represented to be able to do something unless he is sure. I think that will also help. Make sure they know you are coming abroad to see him.
Questions on passports/nationality, legality etc I think people ask embassies and lawyers, wouldn't trust Dennis on that. He can only tell you what he has observed. You need to navigate yourself a bit.
Dr. Wiwat and Dennis both work for Ram group - they are exclusive to each other.

No, I've not in Bangkok. I found the Ram Hospital website through internet and have contacted to Dennis through email. He promised me to let me talk with Dr Wiwat as the process goes on. He askes me to keep in touch especially in Sept (it may reconcile with the time when Thai Govt considers passing the law, as you said earlier).
The thing is that I need an egg donor but simply cannot find any here. I am too happy as Ram provides such a program. I have prepared everything including taking a holiday off from work in Nov (I will be in trouble if taking 2 holidays in a year), taking hormones and doing necessary tests, though I still have so many questions about Dennis respond. To be honest, I am ready to go for Ram and strongly believe that my dream is a hafl way to come true, until I found this website and all of your comments about this hospital. How fustrated and dispointed am I!!!!!My hubby almost gives up when I talk these things to him.

We have made an appointment in Mumbai at Rotunda - Center For Human Reproduction. Had emails from different doctors but all were informed.
Had 3x ICSI in Istanbul; 2 , 3 and 4 embryos. Am 41yrs old.
Surrogacy costs are as follows: (500Euro = Rs28000)
Advertisements to recruit a surrogate Rs 28,000 for two weeks.
IVF Cycle Rs 55,000.
Drugs for IVF approx Rs 65-70,000 depending on doses required. (If high doses are required, this cost could be over Rs 100,000).
Surrogacy Rs 100,000 for Surrogate Preparation.
If Surrogate gets pregnant Rs 350,000 for the three trimesters plus antenatal care.
Rs 50,000 as refundable deposit for medical emergencies/admissions.
Rs.50,000 for the surrogate house wherein the surrogate resides for nine months of pregnancy
Rs 90,000 as one time Insurance cover premium for Surrogate to cover Rs 10,00,000 death liability.
Delivery at actuals (approx Rs 30,000 if Normal delivery & Rs 50,000 if Caesarean).

In January 2008 I did the first payment (~ 500Euro) for the newspaper advertisement for Mumbai at Rotunda - Center For Human Reproduction.
I would take around 4-6 weeks to get a surrogate mother.
However, After 6 weeks I started emailing (4 mails) but nobody responded... So I called the doctor: very friendly and she told me there were some "public issues" in India about foreigners mis-using poor Indian women as a surrogate...
I would be on the waiting list...
So now it's almost June and NO answer whatsoever...
I don't care about the 500Euro, but somehow it feels very wrong at Rotunda/India!

About 16 months ago, I made enquiry to Rotunda about egg donor program. After a few discussion, we were persvaded to put an advert. in the local newspapers. We did it twice (each time cost us about $A500.00). We were looking for egg donor with Chinese origin (evan half/half). In both occassions, We paid Rotunda and Rotunda placed the advert on our behave. Each time we did not receive respponse from Rotunda and I had to ring them after 4-6 weeks from the advert was supposed to be published. When I rang, they simply told us that there was no reply.
I was a little bit suspicious. I did not continue with them after the 2 advertisment simply because I had found a hospital in Thailand to help us.

We are planning to go to Thailand but the agency we have been talking to for many months now is having a problem getting us Chinese donors to choose from. We already gave our down payment but still desperately waiting...

Hi Jenny,
You should ask Hopefulmom and BSM for their experience with Interhealth. I heard they had bad experience with them. I would avoid them if I had the choice. There are other Hospitals in Thailand offer similar programs. Make sure you deal with the hospital and the doctor direct, do not engage an agent. It is likely the agent will run away with our money that you cannot do anything about it/
Get a few quote to compare cost. DO NOT believe a cheap quotation can bring you the desirable outcome. Don't forget, you get what you pay. If everybody charging 500,000baht but somebody offering 250,00baht, there is something wrong.
My understanding is, the fee for egg donor is about 100,00Baht, the IVF medical cost is about 200,000Baht, the fee for a good quality SM is about 500,000Baht. Keep this fee structure in mind. Overall if you can achieve what you want, it is worth it even paying marginally higher cost. Don't forget, a failure for one attempt can cost more than you save.
