Lawyer needed - Blogging Laws
Posted by aworkingmum (157 days ago)
Hi. Is this probably a new and grey area. But can you sue someone for writing about your salandering your life on a blog? If so, does anyone know of a good lawyer who can take care of this matter?

Well it would depend where the blog is based and what grounds you have to prove it's slander.

I have the evidence. It is not the first time. It's like dealing with a psycho-stalker who can't get over the fact that you have broken off the friendship. It is SCARY. She describes me in her blog and has used my name before. Not full name of course.

Not full name ? Then her references can apply to anyone.
I don't think you have a case here.
What you can do, however, is to ask a lawyer to send her a warning letter. People are easily intimidated by that.

Dear Aworkingmum,
Yes you can indeed sue and if you can’t find the defendant you can with leave of the court publish the notice (writ) in the newspaper or even here. To get an injunction you would have to show (on the balance of probabilities) that the reference is to you. It would be a libel suit not slander since the defaming words are in written form.
Good Luck!

^ And wasting a lot of money on a very uncertain outcome. Libel is extremely difficult to prove and most awards, should you win, are rather small. Collecting is another big issue.
